March 23, 1998 Petition to the FCC and 4/29 Conversation Dear Dr. Cleveland, Thank you for returning my call today. I would like to restate the topics we covered so that if I have misunderstood, you can advise me. FCC Meeting Next Week to Decide What to Do with CARE Petition The FCC is still deciding what to do with our petition and this will be discussed at a meeting next week. It is likely that an attorney from the FCC will call and explain the situation after the meeting. The Standards are Set By the Federal Health Agencies Such as the EPA , FDA and OSHA-The FCC Adopts the Guidelines Set by these Health Agencies If we understand what you are saying, the FCC defers to these health agencies on the standard for RMF emissions. Does this mean that CARE must petition all these agencies to change their recommendations from the 200 microwatts per centimeter standard? The FCC Seldom Measures the RF Fields The FCC relies on the applicants to demonstrate that they comply with the standards. The Engineering exhibit to these applications should show these measurements. We will contact the Video Services Branch of the Mass Media of the FCC and request the engineering exhibits for the most recent broadcast applications. Studies of Measurements of RF Fields at Lookout Mountain Antenna Farm We at CARE are aware that measurements have been done on 3 occasions and on each of these occasions, the ANSI standard was exceeded at various locations. Other than the relocation of the KYGO site, we citizens have no information to indicate that any other enforcement action was taken. 1. 1/10/95-Enclosed is a copy of Rick Tell=92s 1/10/95 Study on the Radiofrequency fields by the Jefferson County Nature Center which is located by the Lookout Mountain Antenna Farm. On page 18, the report states that the measurements at 1 point exceed the limits for continuous exposure to the public. 2. 8/8/96- Rick Tell Report to Jefferson County Department of Health A complete copy of this report is exhibit 2 to our petition to the FCC. The information is cross correlated to Dr. Cherry=92s study in our exhibit 5. I understand that you know Rick Tell and had thought that he had advised you that the ANSI standards were not exceeded. This is not accurate. The County only paid Rick Tell to do a quick survey. On page 2 and 5 you will note 3 locations were exceeding the ANSI standards on August 1, 1996. The measurements shown are expressed as a percentage of the ANSI 200 standard. These locations are not shown on the chart in Table 1 or drawn in on the map on page 23. 3. 1977 EPA/FCC Study of Lookout Mountain I understand that you participated in this study and recalled that the worst area was at the KYGO site.
