May "I" emphasize......

There is nothing in the law anywhere (which would stand up under judicial
review) that can prevent that!!!  In spite of what you are being TOLD
about the restrictions of the 1996 Telecom Act......

We need to have some of our good lawyers jump all over these assertions
(coming mostly from industry) ... which claim that "the health issue is
out of bounds."  In spite of the wording of that 1996 Telecom Act (which
is yet unchallenged on this point).  

It would be an incredible "change" in our Constitutional law, which
protects life and privacy rights (both impacted by "health" risks), if
that provision of the Telecom Act were to be upheld by the Supreme
Court.....

No-one (at the time) believed that provision of the law would be upheld
when it was drafted.....  It was written to **intimidate** challenges by
communities and citizens.....  A few (heavily outnumbered) lobbyists on
the side of the people (including Bert Dumpe and Cathy Bergman) tried to
delete those words.....

It was recognized, at the time, as clearly a "sop" to the BIG $$$$$$
contributors to our politicians.....  Both Clinton and Gore had that issue
'all over their faces' (as did the, then, House Speaker, Newt Gingrich) as
they ALL fed -- like PIGS! -- at the trough of "soft money" political
contributions from the telecom industry!!!!

That piece of legislation (1996 Telecommunications Act) was one of the 
WORST examples of how our democracy (read; **oligarchy**) is "working"
today.

The special/vested interests pile their lawyers/lobbyists and Washington
D.C. "public relations" people into the offices of the legislators and
THE INDUSTRY interests are all carefully explained and nurtured through
the law-writing process.....  The public is not at the table!!!!

In theory, our elected representatives are supposed to be looking to the
publics interest ... but it IS NOT working that way under the present
system -- so dependent upon the unremitting and voluminous flow of political
$$$$$$$......

Jacor is also on Lookout Mt. in Colorado.  I would be worried about the
amount of EMR close to the tower that is that low to the ground.  I suggest
you find an expert to take some measurements if anyone lives close to that
tower or at the same altitude as the antenna.  Please see our Web Site
www.c-a-r-e.org.  The Jacor site on Lookout Mt. was over the FCC limits!

TV and Radio zonings do allow us to fight based on health concerns.  The
burden of proof is on the applicant to show that their proposal is in the
best interests of the health, safety and welfare of the community, yet often,
local governments get the burden of proof reversed.
