Subject: Hayden Bill voted through Senate Committee 

On Monday, April 24 the California State Legislature held hearings
before the Senate Business and Professions Committee on Hayden's cell
phone safety bill - SB 1699.  Testifying for the bill were Dr. Henry
Lai and Libby Kelley.

As presently constructed, the bill calls for the California Health 
Department to conduct an RF research assessment and if it is determined 
that there is a need, to develop a consumer statement for a brochure
to be handed out at point of sale in the state and in product packaging 
materials.  

There was a modification agreed to which limits the panel to scientists
in conducting the review. The bill  was voted out of committee  
unanimously over the objections of the two telecom lobbyists who spoke 
against the bill.  There has been a great deal of interest in the bill
from the telecom industry and consumer advocates.  The opponents argued
that the bill unnecessarily duplicates the U.S. Food and Drug
Administration.  Steve Carlson, California Carriers Association, read
the consumer advisory statement released by the FDA in October 1999 as
evidence that FDA was performing the research monitoring and function
and is properly advising the public.  

The proponents argued that the bill was a responsible public 
health approach by California and that there was a need for increased 
public awareness, especially on behalf of children.

The bill carries no fund request attached to it so the next level of 
critical review will be on the Senate floor before it goes to the State 
Assembly.
