Beavers"To: emfguru -------------------------------------------------- ........Yes, I agree - leases are made to be broken...... Probably the surest way to do so in these cases ... is to show a judge that the company installing the tower failed in its "full dsclosure" requirement ... including full disclosure about the health risks to owners and neighbors ... and the property devaluation risk to the whole neighborhood...... I have broken leases before for clients. It is possible. Years ago I had a client in Seattle - apartment manager. U.S. West had installed some antennas on the roof with the transmitting equipment in the basement. The horror stories he told ! Sometimes all that is needed is to appeal to the property owner's greed. Once they learn that some folks are getting as much as $300,000 a year on a lease, things change. Does anyone on the list know of a more lucrative lease than $300,000? From the (nothing's been proven yet, so let us go ahead and kill people till it is gang) - the carrier's standpoint, that must-have site is not so important after all. Funny thing - the need for profit is far superior to the need to fulfill the license requirement to provide service. Leases are made to be broken.
