Subject: Omnipoint: Crime pays???


Re:  Onmipoint (telecom company) challenges Palm Beach County's authority
to regulate zoning of cellular towers.  It built a monopole without a
building permit in Boca Raton, Florida.

Received yesterday letter from Marty Hodgkins, Palm Beach County, Florida
Zoning Director.  The letter addresses a variety of issues discussed on a
phone conversation about cell tower applications status in the county in
the post moratorium era.  Here is what he wrote:

2)  Status of FDOT/Omnipoint Tower at Clint Moore Rd. & the Turnpike - An
application was submitted to the DRC [Development Review Committee] staff
for a tower at this site.  Following staff review however, it was
discovered that the request did not comply with ULDC standards and that one
or more waivers would be required to construct the tower as proposed.
Staff has since been advised that the tower has been constructed without
the required BCC [Board of County Commissioners] (for waivers) and DRC
approvals [building permit].  Code Enforcement Division staff is in the
process of citing Omnipoint for the violation.

Code Enforcement is a joke for industry.  They'll get a slap on their hand,
pay a fine and get it over with.  So much for citizens' rights.......
