I live in rural RI and we are currently in a "battle" with Nextel. They want
to put up a 150 ft tower at a campground that has some year-round, as well as
seasonal, residents, in a fairly densely populated area for this area, across
the street from a federal wildlife bird sanctuary. Nextel came to the first
zoning meeting prepared for battle. They hired a stenographer, everyone who
spoke was sworn in("to tell the truth, the whole truth, and nothing but the
truth"), and they had their experts testify to how safe everything was(RF
engineer, real estate appraiser, tower builder...)Needless to say we were not
prepared for a trial, and although the land abutters and neighbors brought up
some great arguments, it doesn't look too good for us. However, we have been
successful in delaying the final decision to Feb. 3 so that gives us some time
to prepare for a January 13 planning commission meeting. This tower would
violate at least three zoning codes but no one on the zoning or planning board
seem too concerned about that little fact. We haven't given up; one of the
abutters is a lawyer and he plans on helping with the fight. We've put up
signs, are circulating a petition, and plan on having our own "expert"
witnesses at the next planning commission meeting. We will also have an
appeal ready the night of Feb. 3 so we can slap it on them that evening, if
needed. You're e-mail is very useful and I love to see that towers are
