Beavers" Subject: Re: we need your advise Roy, Situation as follows:zoning board meeting last Wed. had about 60 people to voice their concerns. Sprint lawyer had their "experts" but only one got to speak about EMF regarding the fact that they are in compliance with FCC guidelines. Our questions helped to stall before other experts could testify.Meeting went on until midnight. Zoning board got testy with some of us who got emotional about health issues. We have another chance on Feb. l5 where this will be the ONLY issue on the docket. Sprint will be presenting experts in Radio frequency, site plan and planning issues. The health issues cannot be brought up again. We are going to focus only on zoning restrictions now. Our town put together a Master Plan which took l0 years and was completed in l995, one year before the Telecommunications Act of l996.This plan was supposed to stop spot zoning and clearly designates what areas are residential, commercial, industrial. The town paid for this with our tax dollars. Zoning restrictions also include prohibition of building above the ridge line and possible conservation restrictions. We will request that they hold a moratorium until the planning board can incorporte these towers into the plan,which had previously been unforseen. This town is a perfect dish with mountains and valleys. We already have numerous satellite dishes that were fought against and lost, as the judge said they were important for national defense. These dishes have been here for about 25 years. Sprint contends they are filling a gap in service. I personally am going to head a team which will test cell service throughout the town , both phone to phone and phone to home, using our Bell Atlantic and other cell phones. Our core group decided not to use a lawyer for the zoning meeting-$l0,000 dollars just for the meeting-but to consider one if the zoning board turns Sprint down and Sprint appeals. Personally, I voted that we retain a lawyer from the get go but majority rules. We will also be petitioning, running ads, new flyers, etc. We are going to find out what the fire code says for how many people can occupy the room at the Municipal buiding for the zoning meeting. We will try to exceed that limit so that they must, by law stop the meeting, giving us more time. We requested more time last Wed. but they turned us down. There is going to be a combination crane and balloon test on Saturday, Feb. 12. We fought for this and had at least one board member on our side, as Sprint only wanted a crane test which cannot actually get to the EXaCT site and the entire audience moaned in disagreement. It was so interesting to see Sprint's shiny shoed lawyer get up and walk around during the proceedings, a move to distract us. The one zoning board member who is obviously sympathtic told him to sit down. This entire issue is coming on the heels of a major town problem that has existed for 2 years about where to put a tower for a two way radio for the police. Although this site is not where a police tower is needed in Vernon, both issues are related in that our town has not had the foresite to compile a list of appropriate sites to ward against the mega companies trying to muscle their way in. Couple that with your usual small town politics and graft and you've got a mess. I believe we absolutley must implore the zoning board to put a temporary stop on Sprint's proposal until the planning board can revise the Master Plan with these towers in mind.
