......Yes, Brenda, they seek to make it as uncomfortable and costly
for you as they can...... That's SNAFU ... with the electrical industry
and their lawyers..... Try to get as much press coverage
as you can!!!!

They don't like that.... They don't like the glare of publicity in
these situations -- especially if they are beating up on ordinary
citizens... DO WHATEVER YOU HAVE TO ... TO GET MAXIMUM PRESS (TV, ETC)
COVERAGE.....

You are also entitled to delay.... Have the depo taken at YOUR
convenience, not theirs....

I'm sure there are others on the list who may have some worthwhile
ideas....

Subject: ATS IS DEPOSING US

Roy: You will recall I am one of 6 people fighting the construction of a
brand new 1349 ft tower in Newton Upper Falls, MA -- based on zoning. I
got a phone call this afternoon informing me that we six plaintiffs (in our
appeal against American Tower Systems and the City of Newton Board of
Alderman) are being deposed by lawyers for ATS next week. I have been
deposed in another legal case before but other plaintiffs have not so this
will be a new experience for some of them.... Maybe ATS wants to depose us
to harass or frighten us or to run up our bill? I really don't have much to
say about our appeal in a deposition at all. I am concerned about health
issues and property values and these issues are cited in the appeal. However
the appeal will be argued entirely based on zoning. But a deposition
involving 6 people could be continued week after week after week. We
essentially are arguing that the Board exceeded it's authority by granting a
Special Permit for the construction of this brand new 1349' tower that would
house 43 whips and antennas. ATS had 90 days to reply to our appeal --
which would have been April 28. I have been told ATS is taking our case VERY
VERY SERIOUSLY. Has anyone on the list ever been deposed in a case
against a tower? -- Brenda
