Hi everybody:

......I am forwarding below portions of a message from Bert which fill-in
some more interesting background on the Medina case.....

Perhaps we need to remind ourselves that the problem with S. 800 is its
provision that would remove 'industry' from LIABILITY for the health or
safety aspects of their products (including cell-towers, etc.)......  

Frankly, I can't imagine that is a desirable provision in ANY bill on ANY
product.....  

The knee-jerk Republicans, though, seem to be "always ready to go along"
with ANY wording in our health/safety/environmental laws that protect the
rights of INDUSTRY at the expense of the public (meaning: "let's let
the public take the risk," not industry).....

Today I have been watching the debate on the floor of the Senate about
the juvenile-crime bill.....  It is the bill that is intended to correct
the problems in our nation's law enforcement regarding juvenile crimes,
the possession of guns, etc.....  It is a direct result of the recent
Columbine High School shooting in Colorado.....

You may know that overnight, since yesterday, the Republicans were forced
to back down on the original position they had taken in this bill -- which
was protective of the NRA (National Rifle Association) interests.....  

This back-down occurred because people reacted violently and quickly (over
internet and telephone) when the Republican stand in yesterday's Senate
hearing became known to the public....  (Evidently, many millions, like
myself, now make it a practice to watch the hearings on C-span.)

Anyhow, that knee-jerk  "protect our patron (gun) industry friends"
posture of the Republicans showed up on national TV yesterday ... and the
public didn't like it.....

I just want to remind everybody that what you are seeing in that knee-jerk
Republican behavior is **Washington/Wall Street** Republicanism -- not the
"Main Street" Republicanism with which I identify myself.  

I also found myself in agreement with much of what Senators Daschle and
Leahy, both democrats, were saying on the Senate floor today....   The
Republicans are trying to limit debate on this bill -- again, in order to
keep out some amendments which might "tighten" the restrictions against
the gun lobby....

When it comes to dealing with EMF on the Senate floor (S. 800, and the
immunity from liability for "industry"), you are likely to see all the
same political forces at play.....

Roy: Medina is an exclusive affluent small town in the state of Washington
outside Seattle. Medina's claim to fame came when their wonderfully humorous
Mayor Dewey Taylor opposed industry and declared the first moratorium in the
nation against the installation of microwave cell towers in order to preserve 
constitutional self-governing rights of State and local governments. Thereafter,
many cities followed the lead until over 360 moratoria (lasting 3 months to an
indefinite period) were declared nationwide. Moratoria became wo widespead that
the CTIA petitioned FCC to ban them. In response to industry, FCC opened docket
DA-2140. However, the aggressive opposition of state and local governments
nationwide poured into the FCC in the form of letters, briefs and other
communiques. FCC dropped the thought.

Met Dewey at an FCC meeting here in Washington. Trust me, if ALL public
officials were as genuinely dedicated to their constituency, honest, deliberate,
and lighthearted as Dewey, America would be miles ahead in diplomacy and
responsiveness of the people. If Medina is **thinking** of removing cell towers
-- count on it.
