In addition to the excellent explanation provided below by Janet Newton,
may I note that this entire "situaton" is another example of the constant
presence of the industry lobbyists during the drafting of our laws --
while "the public" is not at the table......  The industry lobbyists are
"there" because of our campaign funding laws which actually encourage this
kind of "special interest" bribery.....  That is what makes it so
easy for 'industry' to "slip-in" provisions like the following in an
otherwise perfectly good law.....

"HOW TO" for Submitting Your Letter on S.800

        Please consider signing this letter (part two) requesting changes
to S. 800, the "Wireless Communications and Public Safety Act of 1999."
The letter was written and reviewed by Janet Newton, Executive Officer of
the EMR Network, and David Fichtenberg, Science and Research Advisor to
the EMR Network and President of the Ad Hoc Association of Persons
Concerned about the FCC Health and Safety Rules.

        The House version, HR. 438, was introduced and came to a vote in
barely a week's time.  It was passed almost unanimously.  The Senate
version was introduced on April 14, l999, and is scheduled for hearings at
the Commerce Committee this coming Wednesday.  It could be brought to a
vote in the Senate shortly after that.  Time is of the essence.

        The letter will explain the problem with the proposed language of
this bill.  In essence, the federal government should not be telling the
States how to craft their tort law.  Wireless carriers ARE NOT public
utilities.  They DO NOT participate in the tariff structure by which
states agree to some privileges for the utility in exchange for the
utility's providing a service to all citizens in the State.  Public
utilities are regulated.  Wireless providers ARE NOT
.  Public utilities agree to a fee structure that is negotiated with each
state
.  Wireless carriers are free to set whatever price structure they choose
for the service they offer.  They are private corporations free to create
their own service plans for their customers.

        For-profit corporations DO NOT need immunity from liability
claims from customers just for being in business.  They provide a service
that customers CAN CHOOSE TO or CHOOSE NOT TO purchase.  They can easily
build into their fee structures whatever they need to meet liability
claims.   The taxpayer SHOULD NOT pick up future liability claims against
companies with which many citizens CHOOSE NOT to do business.  It is only
logical that this expense should fall to the provider offering the
service and the customers who choose to use it, and not to the general
public.  The same corporations that deny any negative impacts
from adverse health effects to loss in property values are now seeking
protecti on against liability claims.

        We ask that you FAX your signed letter to the Commerce Committee
to the attention of Moses Boyd at (202) 228-0327.  You must also FAX a
copy of your letter to EACH of your Senators and your Representative in
the House.  This is the ONLY WAY that insures members who are not your
own elected delegation will read your letter.  Call Congress directly at
(202) 226-5200 to request the phone number of your delegations' offices.
Your own member's staff will then give you the FAX number to use.
Remember to send a FAX to three offices, to your two Senators and to your
one Representative.  Time is too short to use the regular mail.  If you
don't have your own FAX or there is none where you work, make a
few inquiries and find a neighbor or local business that has one.
Usually your local Town or City Offices will have one you can use for a
nominal fee.  Make up a FAX transmission cover sheet directing your letter
to the attention of Moses Boyd at the Commerce Committee Minority Staff.

        Please make copies of the letter and this explanation and ask
others at your work or in your neighborhood to join our effort.  This kind
of direct input to members of Congress will not go unnoticed.
