Roy,

I wanted you to be aware of some concurrent activities surrounding the
FCC and tower siting issues.

We have a pending "Petition to Deny" a proposed tower location here in
Georgetown, SC.  The tower is proposed to be located near the
Georgetown Historic District.  We have alleged an FCC failure to
enforce the provisions of the National Historic Preservation Act.

The FCC's Chief Counsel, Mr. Chris Wright, was in Savannah several
weeks ago, speaking at a National Trust for Historic Preservation
meeting.  The title of the telecom tower session was "Faulty Towers
and Dirty Dishes: The 1996 Telecommunications Act and Historic
District Regulation".  I understand he got an earful on how the law
has been ignored regarding these towers.  He should rightfully be
concerned about the efforts required of the FCC to insure the law is
being followed.

We are also pursuing another case here in Georgetown County involving
a Historic Property, Hobcaw Barony, and a tower that was place there
without the FCC required environmental assessment.

The reason I bring this up is because I see a common thread forming.
The FCC is not enforcing their own regulations implementing key
federal environmental laws.  All of these laws require public input
and comment and review opportunities.  Without the required EA's, the
voice of the public is censored.

Perhaps at some point, all the various groups working on these issues
will converge and present a united front from a legal perspective.

Until that happens, I wish all other legal challenges to the FCC luck.
Let's keep up the excellent sharing of information and hope that we
see a crack in this egg soon.
