Beavers (by way of Newtons at Fruitlands )" Subject: Petition to Deny filed w/ FCC Roy, With a great deal of help from the National Trust for Historic Preservation Legal Defense Fund, I recently filed a formal "Petition to Deny" for a tower here in Georgetown, SC. This is the tower SCANA wants to erect next to our Historic District. If anyone wants a MS Word 6.0 or WordPerfect 6/7/8 version of this document, I will be glad to provide it upon request. In this case, we were filing the petition in response to an Environmental Assessment filed by the tower applicant. However, FCC rules provide for anyone filing a "Petition to Deny" to allege a failure by the applicant to establish the public convenience, necessity, or interest for the tower or service. Many thanks for all the help I've received from countless individuals preparing for this filing. We concluded our petition with a quote from the recent Virginia Beach, VA appeals court decision. The judges in that decision overturned a favorable District Court decision for the industry, citing the inevitable barrage of expert studies and opinions that the industry will produce to show they must be allowed to erect a tower. The appeals court said that to ignore the average non-expert opposition to towers would be the equivalent of thwarting democracy. This decision affirms local zoning and the falacy that cities cannot refuse towers. If you haven't seen that decision, you should read it carefully. I have a copy of it too for the asking.
